Terms of Service
Last modified: August 12, 2026
Effective date: August 12, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the mobile application (the "App"), operated by Budgetelo ("we," "our," "us"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
2. Eligibility
Use of the App by persons under the age of 13 requires the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.
To purchase a subscription you must be legally capable of entering into a binding contract in your country of residence. Minors may make purchases only with the consent of a parent or legal guardian, who is responsible for those purchases. Both the App Store and Google Play provide parental controls for in-app purchases.
3. Account Registration and Security
- To use certain features, you may be required to create an account. You agree to provide accurate and complete information when registering.
- Authentication may occur via email verification, Google Sign-In, or Apple Sign-In.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
- We reserve the right to suspend or terminate accounts suspected of unauthorized use, fraud, or violation of these Terms.
4. Acceptable Use
You agree not to:
- Use the App for unlawful, harmful, or fraudulent purposes
- Attempt to reverse engineer, decompile, or otherwise tamper with the App
- Interfere with or disrupt the App's functionality, servers, or networks
- Transmit any harmful code, malware, or unauthorized data through the App
- Use the App in violation of applicable local, national, or international laws
5. Intellectual Property
- All intellectual property rights in the App, including but not limited to software, design, trademarks, and content, are owned by us or our licensors.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
- You may not reproduce, distribute, or create derivative works of the App without our prior written consent.
6. Subscriptions and In-App Purchases
6.1 Free features and Budgetelo Premium
The core of the App is free to use, with no usage limits and no advertising. Creating and managing budgets, accounts, transactions, categories and recurring transactions, cloud sync, the home screen widget, app lock and the Income vs Expense report are all available at no cost.
Budgetelo Premium is an optional paid subscription that unlocks:
- the remaining analytics reports (expense breakdown, category detail, group detail, month comparison and top payees)
- cloud backup and restore of a budget
- creating new payment reminders
- all color palettes and the custom color picker
6.2 Plans, price and billing
- Budgetelo Premium is offered as an auto-renewing subscription with a billing period of either one (1) month or one (1) year.
- The applicable price is displayed in the App before you confirm the purchase, and in the App Store or Google Play, in your local currency and including any applicable taxes. Prices vary between regions and may differ from the prices shown in other countries.
- Payment is charged to your Apple ID or Google account at confirmation of purchase. Apple and Google act as the seller of the subscription; we neither receive nor store your card number, billing address or any other payment credentials.
- If a free trial or introductory offer is made available, its terms will be presented to you at the time of the offer. Any unused portion of a free trial is forfeited when you purchase a subscription.
6.3 Automatic renewal
Your subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours prior to the end of the current period, at the then-current price for your plan.
6.4 Cancellation
You can cancel at any time in the account settings of the store you purchased from:
Cancellation takes effect at the end of the period you have already paid for; you keep Premium access until that date and are not charged again afterwards. Uninstalling the App or deleting your Budgetelo account does not cancel your subscription — you must cancel it through the store.
6.5 Restoring purchases
Your subscription is tied to the Apple ID or Google account used to make the purchase. On a new device or after reinstalling the App, use the Restore Purchases button on the subscription screen to regain access. Access cannot be transferred to a different Apple ID or Google account.
6.6 Refunds
Because Apple and Google process the payment, refunds are handled by them under their own policies and we cannot issue a refund for a charge collected by a store. Refund requests can be submitted at reportaproblem.apple.com (iOS) or Google Play support (Android).
6.7 Right of withdrawal (EU, EEA and UK)
If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you generally have 14 days to withdraw from a contract for digital content or services. Because the subscription is supplied immediately upon purchase with your express consent, and you acknowledge that consent at the point of purchase, this right is lost once performance has begun. Your statutory rights against the store acting as the seller remain unaffected.
6.8 Price changes
We may change subscription prices. A price change never applies to a period you have already paid for — it takes effect at your next renewal, after notice and, where the rules of the App Store or Google Play require it, your consent. If you do not agree to the new price, your subscription will simply not renew.
6.9 What happens when a subscription ends
Ending a subscription never deletes your data and never removes anything from your screen. Your budgets, accounts, transactions and settings remain exactly as they are, the color palette you are currently using stays active, and reminders you have already scheduled continue to fire. What becomes unavailable are Premium actions: backing up and restoring a budget, adding a new reminder, switching to a different color palette (returning to the default palette is always allowed) and opening the analytics reports other than Income vs Expense. Resubscribing restores access to those actions immediately.
7. App Store Terms (Apple)
The following terms apply if you obtained the App from the Apple App Store. They form Apple's required minimum terms and, in case of conflict, prevail over the rest of these Terms with respect to the App obtained from the App Store.
- These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- The license granted to you is a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility.
- We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of such a claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Questions, complaints and support requests concerning the App should be directed to support@budgetelo.com.
8. Third-Party Services
The App integrates third-party services, including but not limited to Google Analytics, Zoho, Supabase, Sentry, RevenueCat (subscription management and purchase validation), and the Apple App Store and Google Play (payment processing). We are not responsible for the availability, accuracy, or privacy practices of such services. Your use of third-party services is subject to their respective terms and conditions. How these providers process your data is described in our Privacy Policy.
9. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.
We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.
10. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App.
- Our total liability for any claim related to the App shall not exceed the amount you paid, if any, for using the App during the three (3) months prior to the claim.
Nothing in this section limits or excludes any liability that cannot be limited or excluded under mandatory law, including mandatory consumer protection law in your country of residence.
11. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if you breach these Terms or engage in prohibited conduct. Upon termination, your right to use the App shall immediately cease.
Termination for breach does not automatically entitle you to a refund of any prepaid subscription period, unless required by applicable law. Terminating your account does not cancel an active subscription — see section 6.4.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the European Union, with the General Data Protection Regulation (GDPR) serving as the primary compliance framework. Any disputes shall be subject to the exclusive jurisdiction of the competent courts located in Poland.
13. Changes to this Terms of Service
We may update our Terms of Service from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms of Service on this page. This policy is effective as of August 12, 2026.
